Use by you of the website constitutes an acceptance of this Privacy Policy.

Introduction

Your data is important to Bespoke Civils Solutions Ltd (BCS), as is your trust in BCS products and services. We are committed to ensuring you privacy and want you to know that the data you share with us will be treated with care. Your personal data may be used by BCS Recruitment but we will not share your personal data with third parties other than associated partners, in order to provide you with an effective Recruitment Service.

 

This policy explains how we collect, store and use your personal data. We will need to do this in order to continue to provide you with our Recruitment Services, help you to find suitable employment, staying in touch after we have found you employment in order for us to continue our service to you, allowing you to be paid for any temporary assignments, or anything else related to our Recruitment Services.

This Privacy Notice applies to the personal data of Candidates, Clients, Suppliers, Referees, Emergency Contacts and all others who we may contact in order to find out more about candidates.

We process data in accordance with the General Data Protection Regulation 2016, from May 25th 2018

This policy applies to any individual we process data for, including Candidates & Clients. For full details regarding the Data Controller and what that entails please read further or seek the General Data Protection Regulations 2016.

Candidates:

In order for BCS to provide you with our Recruitment Services, we have to store your personal details on a secure, computerised database and process certain information about you.

The personal details we store are necessary for us to help you find employment, such as your name, date of birth, contact details, education details, employment history, emergency contacts, National Insurance number, and any other personal details you choose to share with us. We will also ask for details of any unspent criminal convictions at the point of registration in order to satisfy our obligation to our clients.

When gathering information in regards to candidates BCS Recruitment always gain consent before storing data on our secure computerised database. BCS Recruitment will initially explain the process verbally in regards to who will receive candidates data and what BCS recruitment will do with said data this is then always followed by an email which details further what BCS Recruitment will being with said data. All processes and procedures that BCS Recruitment use are fully compliant with The General Data Protection 2016 and in regards to candidate Consent BCS Recruitment would like to direct you to Article 7 of GDPR 2016 to further highlight what s construed and accepted as consent.

We may share (where appropriate) a general, non-specific, overview of your employment history with our clients in order to find you appropriate employment. This will not include any personal details, and we will never share your personal details with third parties without your expressed written consent or unless we have a legitimate interest or legal obligation to do so.

We will process your data for the purposes of marketing relevant job opportunities to you but as above will not send any details across to potential clients until written consent is given and received (Please note if we put you forward for multiple positions then we will generate a consent email for each specific position and company). You may object to this at any time.

We also receive personal data about you from other sources, which include but are not limited to:

  • Your referees may provide us with personal details about you
  • We may obtain information from you if you follow/like us on Social Media
  • We may gain your personal details from one of our clients
  • We may gain your personal details if you have uploaded your CV onto a Job Site that we work in partnership with.
  • We may gain information about you from Linkedin
  • If you were referred to us by an Unemployment service, we will obtain your personal information.
  • If you were referred to us through an RPO or an MSP supplier, we may obtain your personal information from them.

We may need to retain & process your personal data in order to carry out our Recruitment Service to you. This could include, but is not limited to:

  • Collecting your personal details directly from you
  • Collecting your data from third parties, including Linkedin or a Job Site.
  • Reviewing your data to match your skills to suitable job vacancies we may have
  • Storing & updating if necessary your details on our computerised database in order to alert you of job opportunities.
  • BCS Recruitment sending a general, nonspecific overview of your work history to our clients
  • BCS Recruitment sending your CV forward to suitable job vacancies
  • Applying using your CV to our job vacancies, via the BCS Recruitment website or other Job Sites.
  • Carrying out any contractual obligations in relation to your recruitment
  • Allowing the payroll process
  • Carrying out customer satisfaction surveys
  • Requesting information (such as references, right to work in the UK, qualifications and any unspent criminal convictions)
  • Providing references to third parties following the completion of assignment (this will only be done with your specific consent)
  • You do have the right to object to the processing of your personal data in certain circumstances, find out more here.

 

The Personal Data we collect from you & store on our secure computerised database is necessary for BCS Recruitment to continue to provide our recruitment services in an effective manner.

Depending on the nature of the personal data in question, or the reasons why we may be processing it – if you refuse to provide us with such data, we may not be able to meet our recruitment services and this could result in BCS Recruitment not being able to continue with our relationship or offer you our full services. Please be aware that a failure to provide such data may lead to BCS Recruitment being unable to work with you until such data has been received to a satisfactory standard.

 

Transferring your data to third parties:

As part of our Recruitment Services, we may need to share your Personal Data with third parties, including our clients. This will only be done with your specific written consent for each third party or client we disclose your personal data with.

Other than that, we will never disclose your Personal Data with Third Parties unless we are required to by law or we have a legitimate business interest to do so.

Examples of this may include sharing your name, date of birth, National Insurance number, compliance details, bank details, contact numbers etc. with payroll companies or Recruitment Outsourcing companies and neutral vendors, where it is necessary to do so in order for you to undertake a temporary assignment via BCS Recruitment Ltd

We may, where appropriate, disclose a brief & nonspecific overview of your work history to our clients.

Clients:

If you are a client of BCS we will need to collect and use information about you or others at your organisation, in order to effectively provide you with our Recruitment Services. Recruitment Services we offer you may include finding candidates who we believe are a good match for your company; providing you with a Managed Service Provider (“MSP”) programme or providing you with Recruitment Process Outsourcing (“RPO”) services

Bespoke Civils Solutions Ltd collect client data in various ways, including:

  • Data we receive directly from you
  • Data we receive from other sources (including Linkedin, your company’s website, networking events, BCS Recruitment website, business cards, candidates who provide your information as a referee etc.)

In order for us to continue to carry out an effective recruitment service to you, we may need to use and process your personal data. This will include any recruitment service to you, or any other legitimate business need.

In order to do this, our processing activities may include:

Storing & updating if necessary your details on our computerised database in order to contact you with regards to Bespoke Civils Solutions Ltd Services.

Undertaking customer satisfaction surveys

We will keep records on our computerised database of any exchanges with you, including conversations & face to face meetings.

Processing your data for the purpose of targeting appropriate marketing campaigns (you may object to this at any time – details can be found here).

We will never transfer your personal details to a third party unless there is a legal obligation or a legitimate business need.

Suppliers:

BCS Recruitment need a small amount of information from our Suppliers to ensure our continued business relationships. We need contact details of relevant individuals at your organisation so that we can communicate with you. We may also need other information such as your bank details so that we can pay for the services you provide.

We will never transfer your personal details to a third party unless there is a legal obligation or a legitimate business need

Referees/Emergency Contacts:

In order for BCS Recruitment to maintain our Recruitment Services to Clients & Candidates, we need to uptake references and take the details of Emergency Contacts for both employees and candidates.

In order to do this, candidates or prospective employees will provide your contact details to us.

This is so we are able to contact you with regards to a reference, or because you’ve been listed as an emergency contact for one of our candidates or a BCS Recruitment employee.

How long we will store your data

Bespoke Civils Solutions Ltd will delete your personal data from our computerised database if we have not had any significant contact with you (or, where appropriate, the company you are working for or with) for 4 years (or a longer period, if the law requires us to keep your data).

Towards the end of this 4 period, we will contact you to confirm if you wish for BCS to retain your details. If we receive no response, we will delete your data when the 2 year period is complete.

Keeping your data safe

BCS are committed to keeping your personal data safe. We will take every practical and appropriate step to protect your personal data from misuse, loss or unauthorised access.

We have both physical and network security measures in place and a process of how to deal with data breaches. In the unlikely event of a data breach, we will notify you in line with ICO requirements

If we process your personal data for the basis of certain recruitment activities, you may withdraw your consent to this at any time. We will respond to any enquires within 72 hours.

Data Access Requests:

You may ask to view what information we hold about you at any time, and request us to update, modify or delete any information. We will need you to verify your identity in order to do this. We will respond to any enquires within 72 hours. All Guidelines for Access to Data is laid out in The General data Protection Regulations 2016 Article 15. Before any access to data can be given Subjects Identity must be proven to a high standard.

Right to Erasure:

You do have the right to request erasure of your data. Unfortunately, on some occasions, for legal reasons we will be required to keep your data stored on our database (e.g. for HMRC/Tax Purposes). In this instance, we will archive your personal data on our computerised database, and we will no longer process your data.

If you do make a request for erasure of your details, we will need you to confirm your identity in order to complete your request. This runs in Compliance with The General Data Protection Regulation 2016 Article 17

Legal Bases for processing your Data – BCS’s Legitimate Interests

The General Data Protection Regulation (2016) States that BCS can process your data where it “is necessary for the purposes of the legitimate interests pursued by [BCS] or by a third party, except where such interests are overridden by the interests or fundamental rights or freedoms of [BCS] which require protection of personal data.”(Article 6, S1, F) for full details of what classes as a lawful processing of data please see Article 6 GDPR (2016).

BCS believes that in processing your personal data, we are able to provide you with our bespoke and effective recruitment service, and fulfil our services to a higher and more effective standard. But you always have the right to object to us processing your personal data on this basis.

 

Candidates:

BCS believes that it’s realistic to assume that if you are searching for a new job, or have posted your CV/Personal Data onto a Job or Networking Site then you would find it acceptable for us to collect, store and use your information to enable us to conduct our Recruitment Services.

We will use your information to assess your suitability to our current vacancies. We may also provide a brief & general overview of your employment history to our clients, but we will only share your personal details with clients with your consent.

We will also need to confirm your references, right to work in the UK, qualifications and details of any unspent criminal convictions. We need to do this as part of our service to our clients and also you, our candidates.

We also believe it to be reasonable to assume you are happy for us to alert you of relevant job opportunities, however you can object to us processing your personal data for this reason at any time.

To ensure we can continue to provide an effective recruitment service, we also need to use your data for purposes of payroll & invoicing.

We believe all of the above are necessary as part of our legitimate business interest. However if you do not wish for your details to be added to our secure computerised database then please state so on first point of contact with BCS Recruitment following this you can opt out at any point afterwards but identification will need to be proved to a satisfactory standard before this can be achieved.

 

Clients:

In order for us to provide you with an effective recruitment service, we believe it necessary to store your personal details and the personal details of individuals within your business on our secure computerised database.

We believe it necessary to also keep a computerised record on our database of our conversations, meetings, registered jobs and placements. This is in order to ensure we can provide you with the best possible Recruitment Service, and is in both BCS & the client’s interests.

On occasion, we may ask you to participate in a customer satisfaction survey. This is so we can monitor the service we provide to you and continuously improve it.

All of the above we believe to be in line with our legitimate business interests and The General Data Protection Regulations (2016). However an opt out system is always available to all clients this operates on a segmented basis for example you as a client could opt out of receiving Customer satisfaction surveys but still opt in for contact from BCS regarding your recruitment needs.

 

BCS Suppliers:

In order for us to accept the services from our Suppliers, we need collect and store the personal data of individuals within your company. We also need to hold your financial details, in order to be able to pay you for your services.

We believe this is within the scope of our legitimate business interests.

 

Referees/Emergency Contacts:

If your personal data has been provided to us by a candidate of a prospective member of staff in order to gain a reference, we will use your personal data to gain that reference. We believe this is within the scope of our legitimate interests, in order to carry out our recruitment services effectively.

In the same way, if your personal data has been provided to us by a candidate or a BCS employee as an Emergency Contact, we will use your details in order to contact you in case of an emergency. We also believe this to be within the scope of our legitimate business interests.

We will never share Referees or Emergency Contact’s personal details with other parties and your data will only use for the purposes in which it was provided.

 

Cookies and Other Tracking Devices

We may use cookies and other tracking devices on our Websites. Using cookies on our sites provides benefits to you, such as allowing you to maintain your account login information between visits, or locating a nearby dealer. The use of cookies also allows us to measure site activity to provide a better user experience.
